* el niño tiene derechos financieros en el islam, tales como:

(1) herencia: el niño tiene el derecho a heredar cuando sus padres mueren. el bebé es elegible para la herencia cuando está separado de su madre por nacimiento y cuando él muestra un signo de vida como estornudos, llanto, lactancia o cualquier proceso vital. si él muere después, él también es elegible para heredar y ser heredado. si él está vivo y hereda una fortuna, se debe guardar para él hasta que alcance la mayoría de edad. en primer lugar y ante todo, la herencia no se dividirá excepto después de conocer el sexo del bebé, sea niño o niña y el número, un bebé o gemelos etc. ([1]).

 

 

(2) gastos: es el derecho del niño desde que es sólo un feto en el vientre de su madre. la mujer divorciada embarazada debe recibir la pensión alimentaria hasta que da a luz, y su hijo tiene que ser mantenido y provisto por el padre hasta que alcanza la mayoría de edad y se vuelve capaz de ganar su propio sustento. en cuanto a la hija, su derecho de ser provista y obtener sus gastos no libera al padre hasta que esta se casa y se consuma el matrimonio. en caso de que la hija sea divorciada, sus gastos pasan a su guardián o tutor ([2]).

 

 

el padre/educador tiene que ser justo en el gasto de los niños. equidad significa dar a cada uno de ellos lo que necesitan. al niño que estudia, las necesidades de papelería escolar a diferencia del niño que no se inscribe en la escuela. el padre debe ayudar al niño adulto que necesita contraer matrimonio, pero el padre no tiene que dar la misma ayuda financiera al resto de los niños hasta que alcancen la mayoría de edad y necesiten casarse también, puesto que el gasto debe estar de acuerdo con las necesidades de los niños ([3]).

 

 

(3) regalos/subvenciones: se requiere que el padre sea justo al dar subvenciones o regalos a los niños. el debe dar como al-lah el todopoderoso dice en el qurán, a saber: el varón toma el doble de la hembra. al-lah el todopoderoso dice: " al-lah les comanda en cuanto a sus hijos (herencia); el varón, una parte igual a la de dos hembras. " (an-nisa ': 11) el padre puede recuperar su regalo o subvención y tomarla de sus hijos, pero esto sólo se le permite al padre ([4]). el padre tiene derecho a recuperar su donación de sus hijos, si le resulta contrario a las leyes y el espíritu de la sharia. el derecho a revocar un regalo se llama ray'. este acto de caducidad puede realizarse de acuerdo con el decreto de un tribunal competente.

 

 

sin embargo, es un acto condenable y odioso el recuperar un presente, subvención o caridad que se dio a otro musulmán por los sentimientos negativos que esto causa. ibn 'abbas (que al-lah esté complacido con él) informó que el apóstol de que al-lah (la paz sea con él) dijo: "el que recupera su caridad es como un perro que vomita y, a continuación, vuelve a eso y se lo come.” (sahih muslim, libro 12, número 3955). en otra situación, salim informó de ibn umar (que al-lah esté complacido con él) que umar donó un caballo, por al-lah,  luego, descubrió que lo vendían y decidió que comprarlo. umar le preguntó al apóstol de al-lah (la paz sea con él) sobre esto, tras lo cual el mensajero de        al-lah (la paz sea con él), dijo: umar, no recuperes lo que diste en caridad. (sahih muslim, libro 12, número 3954)

 

 

(4) waqf: esuna dote religiosa inalienable en la sharia o ley islámica, normalmente denotando un edificio o una parcela de tierra para los musulmanes o para fines religiosos o caritativos. el niño tiene derecho a asumir su parte del waqf si estaba vivo cuando la waqf fue concedido ([5]).

 

 

(5) testamento: es la adjudicación de la propiedad de cualquier cosa después de la muerte. el testamento puede darse al niño cuando él es sólo un feto en el vientre de su madre, siempre que éste nazca vivo y que esté con vida en el momento de la muerte del testador. la voluntad del niño se cuenta si cumple los diez años de edad, en cuanto al niño de siete años de edad, hay un desacuerdo entre los eruditos en ese sentido ([6]).

inheritance and expenditure

* the child has financial rights in islam such as:

(1) inheritance: the child has the right to inherit when his inherited dies.

the baby is eligible for inheritance when he is separated from his mother by birth and when he shows a sign of life like sneezing, crying, breastfeeding or any of these vital processes.

if he dies afterwards, he is also eligible to inherit and be inherited.

if he is alive and inherits a fortune, it should be kept safe for him till he reaches the age of majority.

first and foremost, the inheritance should not be divided except after knowing the sex of the baby, a boy or a girl, and the number, one baby or twins etc ([1]).

(2) expenditure: it is the child’s right since being just a fetus in his mother’s womb.

the pregnant divorced woman should be given alimony till she gives birth, and her child has to be sustained and provided for by the father till he reaches majority and becomes able to earn his livelihood.

as for the daughter, her right of being provided for and getting her expenses does not drop out of the father till she gets married and the marriages is consummated.

in case the daughter is divorced, her expenses are passed back to her custodian or guardian ([2]).

the parent/educator has to be fair in spending on children.

fairness means to give each of them what he/she needs.

the child who studies needs school stationery unlike the child who is not enrolled at school.

the father should help the adult child who needs to get married, but the father doesn’t have to give the same financial aid to the rest of children till they reach the age of majority and need to get married too as expenditure should be according to children’s needs ([3]).

(3) gifts/grants: the parent is required to be fair in giving gifts or grants to children.

he should give them as almighty allah says in the qur’an, namely the male to take double the female.

almighty allah says: “

allah commands you as regards your children's (inheritance);

to the male, a portion equal to that of two females

.”

(an-nisa': 11)

the father may regain his gift or grant back, and take it from his children, but this is only permitted for the father ([4]).

the father is entitled to get back his donation from his children if he finds it contrary to the laws and spirit of the shari'ah.

the right to revoke a gift is called raj'.

this act of revocation can be done according to the decree of a competent court.

yet, it is a reprehensible and hateful act to take back a present, grant or charity that you gave to another muslim for the negative feelings it causes.

ibn 'abbas (my allah be pleased with them) reported that allah's apostle (peace be upon him) having said this: “he who gets back his charity is like a dog which vomits, and then returns to that and eats it.

(sahih muslim, book 12, number 3955).

in another situation, salim reported from ibn umar (may allah be pleased with them) that umar donated a horse in the path of allah and then found it being sold, and he decided to buy that.

he asked allah's apostle (peace be upon him) about it, whereupon allah's messenger (peace be upon him) said: umar, do not get back what you gave as charity.

(4) waqf: it is

an inalienable religious endowment in shariah or islamic law, typically denoting a building or plot of land for muslim religious or charitable purposes.

the child has the right to take his share from waqf if he was alive when the waqf was given ([5]).

(5) will: it is an endowment with the property of anything after death.

wills may be given to the child when he is just a fetus in his mother’s womb, provided that he/she is born alive and that he/she lives at the time of the testator’s death.

the will of the child is counted if he turns ten years old, as for the seven year old, there is a disagreement between scholars in that regard ([6]).
