normas sobre los niños en el islam

la sharia es la ley islámica general que comprende todas las normas relativas a cada cuestión inherente a la comunidad musulmana. el niño tiene algunas leyes islámicas que mantienen y salvaguardan su vida, dinero, religión y honor. estas serán abordadas brevemente aquí.

 

leyes sobre el infanticidio y el aborto

el niño tiene el derecho a vivir. así, su primer derecho es cumplido a través del estímulo del islam a tener muchos hijos. el profeta muhammed (la paz sea con él), dijo: "cásate con la mujer que es amorosa y fértil, estaré orgulloso de sus grandes números (de hijos) frente a las demás naciones." (clasificado como auténtico por al-albani en irwa' al-ghaleel, 1784) este hadiz indica que se alentó a casarse con mujeres que son fértiles para que aumente el número de la umma y esto hará que el profeta (saaws) se sienta orgulloso del gran número de su umma musulmana en comparación con el resto de las naciones en el día del juicio. esto demuestra que se alentó a los musulmanes a tener muchos niños. en cuanto al llamado control de la natalidad que lamentablemente están promoviendo algunas naciones musulmanas, es una convocatoria misionera que busca debilitar a los musulmanes y minimizar su número. los eruditos han emitido fatwas que indican que el uso de anticonceptivos es admisible si se utiliza para dar a cada niño el tiempo apropiado de lactancia y cuidado materno ([1]), o si el embarazo podría ser un riesgo o peligroso para la vida de la mujer, siempre que sea confirmado por un médico musulmán confiable ([2]).

 

 

* para cuidar al niño y mantener su vida, ciertas normas están establecidas en el islam:

(1) permitiendo a las mujeres embarazadas o que amamantan romper el ayuno, si tienen temor de cualquier daño para sí mismas o para sus hijos ([3]).

 

 

(2) retrasar la ejecución de penas y sanciones a las mujeres embarazadas hasta que den a luz al bebé, lo amamanten y desteten ([4]).

 

 

(3) protegiendo la vida del bebé, desde que es sólo un feto en el vientre de su madre mediante la prohibición del aborto. si es un feto, en los primeros meses, antes de que el espíritu es soplado en él y antes de escuchar el latido de su corazón, los estudiosos tienen diferentes opiniones sobre el aborto en este período; algunos de ellos lo prohíben y algunos de ellos lo permiten pero lo clasifican como un acto condenable. los estudiosos que lo permite con reprensibilidad dejan el asunto a la piedad y la fe de la mujer. "sin embargo, la piedad requiere que el musulmán evite esas sospechas con el temor de involucrarse en algún acto prohibido" ([5]).

 

en cuanto al aborto después de que el espíritu es soplado en el feto, por ejemplo, cuando se escucha el latido de corazón, está por unanimidad prohibido de acuerdo con el islam. si la mujer embarazada o alguien más han abortado el feto intencionalmente y a propósito, hay dos casos:

 

 

* el feto cae vivo y luego muere a causa de este acto, en ese caso la persona que es responsable por la muerte del feto tiene que pagar diiah ([6]). el kaffarah (expiación) por homicidio implica liberar a un esclavo creyente. si uno es incapaz de hacer esto, uno podrá recurrir a ayunar dos meses consecutivos. si no es posible hacerlo, uno debe alimentar a sesenta personas necesitadas. no está permitido que el musulmán  pase de una expiación a la siguiente, a menos que (él o ella) sea realmente incapaz de realizar la primera.

 

 

* el feto cae muerto a causa de este acto, en ese caso el responsable tiene que liberar a un esclavo masculino o femenino. la kaffarah es como se mencionó en el punto anterior.

 

el que realiza este acto no tiene el derecho a heredar nada de la fortuna del bebé fallecido ([7]).

 

 

(4) la obligación de salvar y extraer al bebé fuera del cuerpo de su madre si ella muere por cualquier razón, incluso si requiere una intervención quirúrgica en el cadáver para extraer al bebé ([8]).

 

(5) la obligación de realizar un entierro islámico adecuado. si el feto es de menos de 4 meses, él debe ser envuelto en un trozo de tela y, a continuación, ser enterrado. si es mayor de 4 meses, su cadáver tiene que ser lavado y envuelto, luego se debe rezar la oración fúnebre para él, entonces se le debe asignar un nombre y sepultarlo. esto significa seguir el cortejo fúnebre y ofrecer la oración para el bebé fallecido. si el bebé está vivo y luego muere en el mismo momento del nacimiento o poco después, es sunna (tradición profética) realizar la'aqiqa([9]) por su nacimiento ([10]).

 

 

(6) la obligación de encargarse del bebé abandonado, garantiza su libertad y gastos para él de bait al-maal (el tesoro público musulmán desde el que gasta el gobierno musulmán) ([11]). también, es obligatorio gastar en los huérfanos de los fondos de bait al-maal.

the child has certain islamic rulings that maintain and save his life, money, religion and honor.

rulings of infanticide and abortion

the child has the right to live.

so, his first right is fulfilled through islam’s encouragement to have many children.

the prophet muhammad (peace be upon him) said: “

marry those who are loving and fertile, for i will be proud of your great numbers before the other nations.”

(classed as saheeh by al-albaani in irwa’ al-ghaleel, 1784)

this hadith indicates that it is encouraged to marry women who are fertile, so that the numbers of the ummah increase and this will make the prophet (pbuh) feel proud of the great number of his muslim ummah in comparison to all other nations on the day of judgment.

this shows that it is encouraged to have a lot of children.

as for the call to birth control that sadly some muslim nations are promoting, it is a missionary call that seeks to weaken muslims and minimize their numbers.

scholars issued fatwas that using contraceptives is permissible if it is used to give the child the proper time of nursing and parental care ([1]), or if pregnancy might be a risk or dangerous to the woman’s life, provided that it is confirmed by a trustworthy muslim doctor ([2]).

* to care for the child and keep his life, certain rulings are set in islam:

(1) permitting to break the fast of pregnant or nursing women if they are afraid of any harm on themselves or their children ([3]).

(2) delaying the execution of punishments and sanctions on pregnant women till they deliver the baby, nurse and wean him ([4]).

(3) protecting the life of the baby since it is just a fetus in his mother’s womb by prohibiting abortion.

if he is a fetus in the first months, before the spirit is breathed into him and before hearing a heartbeat, scholars have different opinions concerning abortion at this period;

some of them prohibit it and some of them permit but classify it as a reprehensible act.

the scholars who permit it with reprehensibility leave the matter to the piety and faith of the woman.

“yet, piety requires the muslim to avoid such suspicions for fear of getting involved into any prohibited act” ([5]).

as for abortion after the spirit is breathed into the fetus, namely hearing a heartbeat, it is unanimously prohibited according to islam.

if the pregnant woman or someone else aborted the fetus intentionally and on purpose, there are two cases:

* the fetus falls alive then he dies because of this act, in that case the person who is responsible for killing the fetus has to pay diyah ([6]).

the kaffarah (expiation) for manslaughter involves freeing a believing slave.

if one is unable to do this, one may resort to fasting two consecutive months.

if it is not possible to do so as well, one is to feed sixty needy persons.

the muslim is not allowed to move from expiation to the next unless he/she is really unable to do the first.

* the fetus falls dead because of this act, in that case the doer has to free a male or female slave.

the kaffarah is as mentioned above in the previous point.

the doer of this act does not have the right to inherit any of the deceased baby’s fortune ([7]).

(4) the obligation of saving and getting the baby out of the body of his mother if she dies for any reason, even if it requires a surgical operation on the dead body to extract the baby ([8]).

(5) the obligation of proper islamic burial.

if the fetus is less than 4 months, he should be wrapped in a piece of cloth and then be buried.

if he is older than 4 moths, his corpse has to be washed and enshrouded, then to pray the funeral prayer for him, then to be named and buried.

this means to follow the funeral procession and offer the prayer for the deceased baby.

if the baby is born alive then he dies at the same moment of birth or shortly after, it is sunnah (prophetic tradition) to do

'aqeeqah ([9]) for his birth ([10]).

(6) the obligation of embracing the forsaken or left baby, guaranteeing his freedom and spending on him from bayt al-maal (the muslim public treasury from which the muslim government spends) ([11]).

also, it is obligatory to spend on the orphans from bayt al-maal.
