después del nacimiento del niño se recomienda recitar el adzan (llamado a la oración) en su oído derecho siguiendo el ejemplo del profeta muhammed (la paz sea con él) cuando él recitó la llamada a la oración en el oído de al hassan (ra) ([1]) ([2]). de esta forma, la palabra del tauhíd (monoteísmo) sería lo primero que niño oiga, por lo que satanás se alejará de él aunque solo sea un bebé. también se recomienda felicitar a los padres diciendo: "que allah bendiga su hijo. gracias al otorgador por su bendición. que crezca fuerte. que sea bondadoso con usted"([3]). es una sunna (tradición profética) ofrecer la'aqiqa([4]) en el séptimo día luego del nacimiento del niño para celebrar su nacimiento, con la esperanza y orando por que viva una vida larga y recta. la ' aqiqa es como ' udhiah (sacrificio especial de animales durante la peregrinación) excepto que es preferible no romper los huesos del animal sacrificado como en la ' udhiah. cocinar la carne y ofrecer un banquete es mejor que dar a la gente la carne cruda. dos familias no deben sacrificar una ' aqiqa, porque no hay ninguna evidencia de la validez de tal acto de acuerdo a la sunna ([5]). la ' aqiqa por el nacimiento de un niño tiene que realizarse sacrificando dos ovejas o cabras y una cabra u oveja por el nacimiento de una niña ([6]). es permisible retrasar la celebración de la ' aqiqa si no es accesible para el padre ([7]), por lo que puede ser celebrado luego de 14 o 21 días del nacimiento.

 

 

los beneficios de practicar esta sunna:

satanás se aferra al bebé en el minuto que viene al mundo para alejarlo de la fitrah (disposición natural al monoteísmo). la ' aqiqa es el medio para liberar la promesa del niño ([8]). el profeta (la paz y bendiciones de al-lah sean con él) dijo: " a todos los niños se les promete su ' aqiqa, que deben ser sacrificados en su nombre en el séptimo día, y él debe ser afeitado y asignarle su nombre." ([9]) ([10]) los padres tienen que asignarle un buen nombre al niño; la designación de los nombres debe ser después del parto o en el séptimo día de nacimiento ([11]). el padre debe elegir los mejor nombres porque cuando el niño crezca va a darse cuenta del buen sentido de su nombre, él se apegará a este significado en términos de hechos y modales y él tratará de no contradecir el buen sentido del nombre ([12]). la asignación de nombres es el derecho del padre, pero consultar a la madre y sus hermanos afirmará definitivamente la afinidad entre los miembros de la familia ([13]).

 

 

los mejores nombres para al-lah el todopoderoso son:    abdul-lah (siervo de al-lah) y abdur-rahman (sirviente del misericordioso) y, además cualquier otro nombre que refleja la humildad del hombre ante su señor, como lo indica el hadiz que dice, "los mejores nombres para al-lah son abdul-lah y abdur-rahman". (informado por muslim, abu dawud, al-tirmidzi y ibn mayah) se recomienda también nombrar a nuestros hijos como los profetas y mensajeros de al-lah, también, con nombres de los hombres justos, y luego cualquier otro nombre que el islam no prohíba, por ejemplo: los nombres que no tengan ninguna mancha de shirk o nombres que sugieran ideas que son repugnantes al islam. cualquier nombre que contenga o implique (asociación de socios con al-lah) está prohibido, como es el caso de nombres tales como: sirviente de muhammad, siervo del profeta, siervo de la ka'bah y así sucesivamente. también está prohibido nombrar a los niños con los nombres de de los politeístas, ateos o no-creyentes, como los faraones, opresores y tiranos. está prohibido asignar a los niños nombres tales como: rey de los reyes, el juez de los jueces y el gobernante de los gobernantes. el profeta (saaws) dijo: "el nombre más vil que se le puede dar a un ser humano es maliku ' l-amlak, o "rey de reyes, "porque nadie puede ser tal sino allah mismo." no es admisible dar a los niños los nombres de los demonios, como: janzab (un demonio que pone dudas en el momento de la oración), al-walhan (demonio de la ablución), al-awar (demonio de la fornicación), al-agda y al-habab. también, no es correcto dar a los niños nombres que implican recomendación, como barrah (piadoso), aflah (feliz), iasar (abundancia), nayih (próspero), baraka (bendición) y ia'li (elevado). el profeta (saaws) dijo: "no debes nombrar tus esclavos: iasar (abundancia), rabah (ganancia), nayih (próspero), aflah (feliciz), porque si usted solicita de uno de ellos su servicio doméstico, y él no estará presente, la respuesta negativa expresará que la abundancia, o ganancia o prosperidad, o felicidad, no están en su vivienda." lo mismo se aplica a nombres como iman (fe), huda (guia), malak (angel) y así sucesivamente. se prohíbe tener nombres que implican algo negativo, odioso o desafortunado, tales como: harb (guerra), haia (serpiente), morra (amargo), huzn (tristeza), asiah (disobedient) y todos los nombres de ese tipo. no es agradable asignar los nombres de los ángeles ([14]).

 

 

queda prohibido el nombre del niño saiid walad adam (jefe de hijos de adán), saiid al-bashar (jefe de humanos) porque se trata de títulos del profeta muhammed (la paz sea con él). la prohibición de llevar el nombre del profeta muhammad (saaws) y su apodo, era sólo durante su vida. después de la muerte del profeta muhammad (saaws) fueron nombrados cuatro hijos de sus compañeros fueron nombrados muhammed y apodados abu al-qasim ([15]). también es aplicable a los nombres de las hijas, se recomienda llamarlas como la mujer justas de los compañeros mujeres y las mujeres piadosas, tales como: asia (esposa del faraón), hayar y sarah (esposas del profeta ibrahim, la paz sea con él), además de los nombres de las esposas e hijas del profeta muhammed (saaws), como aisha, jadiya, fátima, ruqaiiah y um kuldzum.

 

 

la legitimación del linaje y filiación del niño, están comprobadas por su nacimiento, debido a que sobre esta base, el niño obtiene otros derechos legales, tales como la tutela, custodia, cuidado, herencia, testamento, waqf ([16]), subvención o regalo, gastos y otros derechos del niño y también los derechos de los padres, hermanos y parientes ([17]).

 

 

el linaje del niño está comprobado por el nacimiento de su madre casada o de la mu'taddah (mujer en período de espera después del divorcio o la muerte de su esposo) luego de pasados al menos seis meses desde que el matrimonio ha sido consumado. si se desconoce el linaje del niño, y un hombre dice ser el padre, el linaje de este hombre está aprobado, siempre que sea capaz de ser padre de un niño o elegible y nadie más discuta con él sobre el parentesco de este niño. estas decisiones son detalladas y se explican en la jurisprudencia y en los libros de la sharia ([18]).

naming, 'aqeeqah and legitimation (lawful birth)

after the birth of the child it is a recommended to recite the athan (call to prayer) in his right ear to follow the footsteps of the prophet muhammad (peace be upon him) when he recited the call to prayer in the ear of al hassan (ra)

([1]) ([2]).

this way, the word of tawheed (monotheism) would be the first thing that the child hears, so satan will run from him ever since he is just a baby.

it is also recommended to congratualate the parents by saying: “may allah bless your child.

thank the bestower for his blessing.

may he grow up to be strong.

may he be benign to you” ([3]).

it is a sunnah (prophetic tradition) to give

'aqeeqah

([4]) in the seventh day of the child’s birth to celebrate his birth, hoping and praying that he lives a long righteous life.

'aqeeqah is like 'udhiyah (animal sacrifice especially during pilgrimage) except for preferring not to break the bones of the slaughtered animal like the 'udhiyah.

cooking the meat and offering it to people in a banquet is better than giving it to people as a raw meat.

two families should not slaughter one 'aqeeqah because there is no evidence of the validity of such act according to sunnah ([5]).

the 'aqeeqah for the birth of a boy has to be by slaughtering two sheep or goats, and one goat or sheep for the birth of a girl ([6]).

it is permissible to delay the celebration of 'aqeeqah if it is not available for the parent ([7]), so it can be celebrated on the 14th day of the birth or the 21st.

the benefits of practicing this sunnah:

satan clings to the baby the minute he comes to the world to distance him from fitrah (natural disposition of monotheism).

the 'aqeeqah is the mean to release the pledge of the child ([8]).

the prophet (peace and blessings of allah be upon him) said: “every child is held in pledge for his 'aqeeqah, which should be slaughtered on his behalf on the seventh day, and he should be shaved and given his name.”

([9]) ([10]) parents have to name the child a good name;

the naming should be after the birth or in the seventh day of birth ([11]).

the parent should choose from the best of names because when the child grows up to realize the good meaning of his name, he would make sure to adhere to this meaning in terms of deeds and manners and he would try not to contradict with the good meaning of the name ([12]).

naming is the right of the father, but consulting the mother and siblings would definitely ascertain affinity among the members of the family ([13]).

the best names to almighty allah is abdullah (servant of allah) and abdur-rahman (servant of the merciful one), then comes any other name that reflects man's humility before his lord, as indicated by the hadith that reads, "the best names in allah's sight are abdullah and abdur-rahman."

it is also recommended to name our children after the prophets and messengers of allah, then the righteous men, then any other name that islam does not prohibit, namely names that have no taint of shirk or names that suggest ideas that are repugnant to islam.

any name that contains or implies shirk (associating partners with allah) is prohibited as is the case with names such as servant of muhammad, servant of the prophet, servant of ka’bah and so on.

it is also prohibited to name the children after polytheists and disbelievers such as the pharos, oppressors and tyrants.

it is banned to name children with names such as: king of the kings, judge of the judges and ruler of the rulers.

the prophet (pbuh) said: “the vilest name you can give a human being is maliku ‘l-amlak, or ‘king of kings,’ because no one can be such but god himself.”

it is not permissible to give children the names of the devils such as khanzab (a demon who casts doubt at the time of prayer), al-walhan (demon of ablution), al-awar (demon of fornication), al-agda and al-habab.

it is also not right to name children with names that imply recommendation such as barrah (pious), aflah (felicitous), yasar (abundance), najih (prosperous), baraka (blessing) and ya’li (elevated).

the prophet (pbuh) said: “you must not name your slaves yasar (abundance), rabah (gain), najih (prosperous), aflah (felicitous), because if you ask after one of these your domestic servants, and he be not present, the negative reply will express that abundance, or gain, or prosperity, or felicity, are not in your dwelling.”

the same applies to names such as iman (faith), huda (guidance), malak (angel) and so on.

it is inhibited to have names that imply negative, hateful or misfortunate meaning such as: harb (war), haya (serpent), murra (bitter), huzn (sadness), asyah (disobedient) and all names of that sort.

it is disliked to be named after the names of the angels ([14]).

it is prohibited to name the child sayed walad adam (chief of sons of adam), sayed al-bashar (chief of humans) because these are titles of the prophet muhammad (peace be upon him).

banning the bearing of the name of the prophet muhammad (pbuh) and his nickname was only during his lifetime.

after the death of the prophet muhammad (pbuh) four sons of the companions were named muhammad and nicknamed abu al-qasim ([15]).

it is also applicable to the names of the daughters, it is recommended to name them after the righteous women of previous nations, the female companions and righteous women such as: asia (pharaoh’s wife), hajar and sarah (wives of prophet ibrahim peace be upon him), in addition to the names of the prophet muhammad’s wives and daughters such as aisha, khadijah, fatimah, ruqayyah and om kolthoum.

the legitimation of the child’s lineage and parentage is proven by his birth, because based on this the child gets other legal rights such as guardianship, custody, nursing, inheritance, will, waqf ([16]), grant or gift, expenditure and other rights of the child and also rights of parents, siblings and relatives ([17]).

the lineage of the child is proven by birth from his married mother or from the mu’taddah (woman in waiting period after her divorce or death of a husband) after the passing of at least six months since marriage has been consummated.

if the lineage of the child is unknown, and a man claims to be the parent, the lineage to this man is proven, provided that he is allegeable or capable to father a child and no one else is disputing with him over the parentage of this child.
